THESE TERMS AND CONDITIONS CONTAIN IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS, INCLUDING YOUR WAIVER OF LIABILITY, YOUR ASSUMPTION OF RISK, YOUR WAIVER OF CLASS ACTION RIGHTS, AND YOUR AGREEMENT TO BINDING ARBITRATION.

BY PURCHASING A TICKET OR ENTERING THE PREMISES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS.


I. Ticket Policy and Admission

All Sales Final:
All tickets and packages are non-refundable. No refunds, credits, reimbursements, or exchanges will be issued for any reason, including illness, weather, travel issues, dissatisfaction with the experience, or inability to attend.


One-Time Ticket Change Policy:
Guests may change their ticket 1 time only to a different available date or time through our authorized third-party ticketing provider.
If the new date or time has a higher price, guests must pay the difference.
If the new date or time has a lower price, no refund or credit will be issued.
After 1 change, no further changes or refunds may be made for any reason.


Admission Requirements:
Each ticket admits 1 person unless otherwise stated.
A valid, government-issued photo ID is required for all guests.
Entry may be refused at the sole discretion of the Organizer for reasons including intoxication, disorderly behavior, or violation of venue policies.
Re-entry is not permitted.


Age Policy:
This event is strictly 21+ at all times.
No exceptions will be made.
Guests who fail to present valid ID or meet age requirements will not be admitted and will not receive a refund.

II. Assumption of Risk and Waiver of Liability (Including Infectious Diseases and Other Risks)


Assumption of Risk:
Attendance at a public venue and participation in this event involves inherent and unforeseeable risks that may result in property damage, loss, personal injury, illness, permanent disability, or death. These risks include, but are not limited to:

Exposure to communicable or infectious diseases, including COVID-19, SARS-CoV-2, influenza, RSV, norovirus, and any other virus, bacteria, or illness.

Slip, trip, and fall hazards, including wet surfaces, uneven flooring, steps, lighting changes, crowding, furniture, decor, and temporary installations.

Risks associated with alcohol consumption, including impairment, intoxication, adverse reactions, allergic reactions, interactions with medications, and the actions of impaired individuals.

Risks arising from the conduct of other guests, including accidental contact, crowd behavior, harassment, assault, or other third-party actions.

Risks related to venue operations and conditions, including noise, flashing lights, low visibility, and emergency situations.

You voluntarily assume all risks, known and unknown, foreseeable and unforeseeable, associated with entering the venue, attending the event, and participating in any activities on the premises.


Waiver and Release:
You, on behalf of yourself and your heirs, executors, administrators, and assigns, hereby waive, release, and discharge Holiday Pop Up Bars LLC, 
Bracket Bar, the venue owner and landlord if applicable, and each of their respective officers, directors, owners, members, managers, employees, contractors, agents, affiliates, volunteers, sponsors, insurers, and successors the Released Parties from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses of any kind, whether known or unknown, arising out of or related to your attendance at the event or presence on the premises.

This includes claims arising from personal injury, illness, disease, death, or property loss, exposure to any communicable or infectious disease, the actions or omissions of other guests or third parties, and the ordinary negligence of any Released Party, to the fullest extent permitted by law.

This waiver does not apply to claims arising from gross negligence or willful misconduct to the extent such waiver is prohibited by law.


Tickets Purchased for Others:
If you purchase tickets for or transfer tickets to other individuals, you confirm that all such individuals have independently reviewed and accepted these Terms.

Indemnification:
You agree to indemnify and hold harmless the Released Parties from all claims, losses, liabilities, damages, judgments, penalties, and expenses, including attorneys’ fees, arising from or related to your attendance, conduct, violation of these Terms, or violation of any law or the rights of any third party.


III. Health and Safety Acknowledgment


Guests must comply with all venue rules, posted instructions, and any health, safety, and security requirements imposed by the City of Chicago or State of Illinois, including alcohol service policies and capacity limits. Failure to comply may result in removal or denial of entry without refund.

IV. Conduct and Removal


Guests must behave responsibly and respectfully at all times. The Organizer reserves the right to remove or deny entry to any guest for reasons including intoxication, illegal substance use, harassment, misconduct, property damage, failure to follow staff instructions, or violation of these Terms or applicable law.

Removed guests will not receive a refund or credit.

V. Limitation of Liability


To the fullest extent permitted by law, the Released Parties shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages arising out of or related to attendance at the event or activities on the premises.

VI. Binding Arbitration and Class Action Waiver


Agreement to Arbitrate:
Any dispute arising out of or relating to these Terms, ticket purchase, or attendance shall be resolved exclusively by binding arbitration administered by the American Arbitration Association. Both parties waive the right to a jury trial.


Class Action Waiver:
All claims must be brought individually. Class, collective, or representative actions are not permitted.


Location and Governing Law:
Arbitration shall take place in Cook County, Illinois. These Terms are governed by the laws of the State of Illinois and the Federal Arbitration Act.


Informal Resolution Requirement:
Before initiating arbitration, written notice describing the dispute must be sent to:

Both parties agree to attempt informal resolution for 60 days prior to arbitration.


VII. Governing Law and Venue

If arbitration is not initiated, any legal action must be filed exclusively in the courts of Cook County, Illinois.


VIII. Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.


IX. Entire Agreement

These Terms constitute the entire agreement between you and Holiday Pop Up Bars LLC DBA Bracket Bar regarding ticket purchases and attendance.


X. Acknowledgment

By purchasing a ticket or entering the venue, you acknowledge that you have read, understood, and agree to all Terms and Conditions, including the waiver of liability, assumption of risk, arbitration agreement, and class action waiver.
